National Action Network Phoenix Metro Alleges Disparate Treatment and Retaliation by Arizona State Bar

Civil Rights Organization Cites Systemic Bias, Intimidation, and the Bar's Refusal to Address Concerns Raised by Attorneys Across Political Spectrums

PHOENIX, AZ — [June 3, 2025] — The Phoenix Metro Chapter of the National Action Network (NAN) is raising urgent concerns over what it describes as a pattern of disparate treatment, retaliatory practices, and institutional silence by the Arizona State Bar. The civil rights organization reports that multiple attorneys—many from marginalized backgrounds or representing underrepresented communities—have come forward alleging unfair disciplinary actions, procedural inconsistencies, and a culture of intimidation for those who speak out.

According to NAN Phoenix Metro, initial outreach to the Arizona State Bar resulted in an invitation to visit and learn more about the Bar’s disciplinary processes. However, the Bar declined to discuss any specific disciplinary cases or address the serious concerns raised by affected attorneys, leading the organization to characterize the gesture as performative and lacking substance.

“Our goal from the beginning has been to shed light on serious concerns about fairness, due process, and potential systemic bias in the Bar’s disciplinary practices,” said a NAN Phoenix Metro spokesperson. “Despite our good-faith efforts, the Arizona State Bar has not only refused to engage meaningfully—it has cut off communication entirely.”

The Bar’s decision to end communication followed a letter from NAN Phoenix Metro seeking a conversation about the unjust experiences shared by numerous attorneys. Rather than addressing the issues raised, the Bar cited the “tone” of the letter as the reason for halting dialogue—an action NAN views as both dismissive and indicative of a larger pattern of avoidance.

One of the most compelling aspects of the testimonies NAN received is that the impacted attorneys represent a broad political spectrum—including conservatives, moderates, independents, and progressives. “This confirms what we have said all along: this is not a political issue,” the spokesperson emphasized. “It is a civil and human rights issue that transcends ideology.”

The attorneys’ accounts describe inconsistent disciplinary standards, lack of due process, and an environment where retaliation discourages dissent. NAN contends that individual and solo practitioners, especially those representing vulnerable populations, are disproportionately targeted—while large corporate law firms appear largely shielded from similar scrutiny.

“This is a two-tiered system of discipline,” said the spokesperson. “Individual attorneys are being penalized for advocacy and accountability, while corporate law firms are allowed to operate with impunity. That’s not regulation—that’s repression.”

The national implications of this misconduct are alarming, NAN warns. “The disparate treatment and retaliatory actions imposed by the Arizona State Bar have nationwide consequences,” the spokesperson said. “They send a chilling message: if you challenge systemic injustice, you risk punishment.”

NAN Phoenix Metro Calls for Action:

• A public, independent review of the Arizona State Bar’s disciplinary practices;
• Open and accountable dialogue between the Bar and civil rights organizations;
• State-level oversight and investigation into patterns of bias or abuse;
• Protections for attorneys who face retaliation for raising concerns;
• And support from elected officials, community leaders, and advocacy organizations.

“These are attorneys committed to justice,” said the spokesperson. “When the very systems meant to uphold the rule of law become hostile to accountability, the consequences ripple throughout society.”

NAN Phoenix Metro affirms its commitment to continue advocating for impacted attorneys, hosting public forums, and working with national civil rights partners to demand transparency, fairness, and reform.
