The Washington Free Beacon in June reviewed newly discovered audio recordings of Hillary Clinton. The recordings dubbed the Hillary Tapes by the press were from the time period of 1983-1987. In these recordings Hillary discusses representing a 41 year old male who was accused of raping a 12 year old girl in Arkansas.
In these tapes which were to be used for an Esquire feature on her and Bill Clinton which was never published she makes many usual comments regarding her defense of her 41 year old client. For example Hillary states he took a lie detector test. I had him take a polygraph which he passed which forever destroyed my faith in polygraphs." After making this comment one can hear Hillary laughing.
Hillary continues to explain (and laugh) that the state made an error in the handling of evidence particularly the testing of the underwear of the male which had blood on them. After discussing how she convinced the judge the state did not follow proper protocol in the testing of the material (after testing the state discarded the underwear sample not allowing the defense a chance for independent testing) the interviewer asked how the case was resolved. Hillary then states Oh he plea bargained. Got him off with time served in the county jail hed been in the county jail for about two months."
Nobody can fault Hillary for taking the case. Our judicial system guarantees one who is charged a right to a fair trial and defense. As a young lawyer just starting her career one cannot argue that this man deserved a right to a defense and Hillarys acceptance to provide such defense. However as Ronald D. Rotunda a professor of legal ethics at Chapman University stated about defense lawyers in the Washington Free Beacon story We dont have to believe the client is innocent…our job is to represent the client in the best way we can within the bounds of the law." However disclosure of the clients polygraph and guilt raises ethical concerns as it could be a violation of attorney-client privilege. According to Rotunda You cant do that...unless the client says: Youre free to tell people that you really think Im a scumbag and the only reason I got a lighter sentence is because youre a really clever lawyer."
However outside of the ethical issue of failing to maintain attorney-client privilege there is a more disturbing aspect of her discussion of this trial. As noted above Hillary can be heard laughing repeatedly throughout the discussion with absolutely no empathy for the 12 year old victim in the case.
The victim who was interviewed by the Daily Beast after the Hillary Tapes were made public even accused Clinton of intentionally lying about her in court documents and going to great lengths to discredit the rape evidence. The victim also stated Hillary Clinton took me through Hell" and if she saw Hillary she would challenge Hillarys hypocrisy of allegedly supporting womens rights in comparison to Hillarys actions regarding this case. According the Daily Beast the victim continued I would say to Clinton You took a case of mine in 75 you lied on me… I realize the truth now the heart of what youve done to me. And you are supposed to be for women? You call that being for women what you done to me? And I hear you on tape laughing."
Let us not forget that when Bill Clinton was running for president and the news on a long lasting extra-marital affair with Gennifer Flowers broke in the media which threatened Bills campaign Hillary stated We have to destroy her!" Why is all of this of importance to the public? Hillary constantly in media appearances and on her recent book tour champions her work for womens rights and advocacy as proof of her commitment to feminism. Really? What we have in Hillary is a woman who for years has accepted a philandering husband for the sake of the maintenance of power and hopes of a presidential run a woman who put a 12 year old rape victim through hell" and a woman who shows outright disdain to any other woman who does not have the same education social or financial status as she does.
