Arizona Senate President Refers Kris Mayes, Adrian Fontes to the DOJ for Prosecution Related to 2020 Election Investigation

Arizona Senate President Warren Petersen (R-Gilbert) sent a letter to the Department of Justice (DOJ) on Monday requesting a criminal investigation into Arizona Attorney General Kris Mayes and Arizona Secretary of State Adrian Fontes. He accused them of “obstruction of justice” and “witness tampering” in regards to cooperating with the Trump administration’s investigation into election wrongdoing. 

The FBI served a grand jury subpoena on the Arizona Senate in March requesting election records from their investigation into wrongdoing in the 2020 election. The Arizona Senate complied. 

Mayes and Fontes sent letters last month to all 15 Arizona county recorders threatening them with Class 6 felony prosecutions if they complied. An attorney for Mayes sent a letter a week ago to Petersen’s chief of staff and Senate Rules Attorney demanding to know what information the Arizona Senate turned over to the FBI in response to its grand jury subpoena. Fontes has also refused to turn over the state’s voter registration database to the DOJ after being sued. Fontes said he would go to jail before releasing it.

Petersen attached a letter providing legal advice from his attorneys at Snell & Wilmer which stated, “The Attorney General and Secretary’s contrary position is unsupported by law and, if acted upon, could itself constitute obstruction of justice or witness tampering.”
